OCERS Disability Retirement Benefit Lawyers Anaheim
Orange County Employees Retirement System: Disability Retirement Application & Appeals – Los Angeles, Orange County
If you are an Orange County public employee and you become permanently disabled while a member of OCERS, you may be eligible for a Disability Retirement allowance.
At the Law Firm of Cantrell Green, our experienced disability retirement attorneys can guide you through the process and help you obtain the maximum disability retirement benefits available through your OCERS plan.
There are two types of disability benefits payable from OCERS:
(1.) OCERS Non-Service Connected Disability Retirement –
(a.) An employee is eligible for OCERS Non-Service Connected Disability Retirement allowance if:(a.) He or she has five or more years of Service Credit; and,
(b.) The Board of Retirement determines that the employee is permanently physically or mentally incapacitated rendering them unable to perform the usual and customary duties of any permanent assignment in their job classification; and,
(c.) The employee’s disability is not due to a job-related illness or injury.
(2.) OCERS Service Connected Disability Retirement –
You are eligible for OCERS Service Connected Disability Retirement if:
(a.) The Board of Retirement deems the employee permanently physically or mentally incapacitated rendering them unable to perform the usual and customary duties of any permanent assignment in their job classification; and,
(b.) The employee’s incapacity arose out of, and in the course of, their employment; and,
(c.) Such employment contributed substantially to the employee being incapacitated.
More complete details about each individual public employee’s OCERS benefit plan can be found in the employee’s Summary Plan Description (SPD). However, while the SPD provides disclosure of the terms and conditions of the employee’s OCERS disability retirement, the employee’s benefits can also be affected by new or existing laws, statutes, resolutions, regulations, and policies governing the administration of OCERS.
Unfortunately, these complex rules, regulations and policies can result in deserving OCERS members being denied their well-earned disability retirement benefits. The only way to ensure that you receive the maximum disability retirement benefits you deserve is to consult a disability retirement lawyer who is experienced in OCER cases.
